Protecting Press Content and the Use of Media Monitoring

The evolving digital media landscape presents various challenges for the press sector. These include the rise of artificial intelligence, the spread of disinformation, and the systematic reproduction of publishers’ content without any compensation. Press publishers make the necessary investments to ensure independent, high-quality, and reliable information while also safeguarding their content. It is only fair that publishers have control over what happens to their content and how it is reused.

In addition to discussions with major players (e.g., international platforms), one of the measures taken to protect press content is to prevent (online) content from circulating freely, such as internal distribution within a company. Press content will still be accessible on the chosen platform, but downloading press content will no longer be permitted.

This entails slight modifications to the functioning of media monitoring. Moving forward, access to press content via media monitoring service providers’ platforms will require a personal login and password. The first three logins are included in the contract with the clipping services, while any additional logins will require an extra license from the management organizations License2Publish (NL) or Copiepresse (FR).

This new working method has been integrated into contracts between media monitoring service providers and management organizations. Clients of media monitoring service providers are therefore required to review and, if necessary, adjust their arrangements accordingly.

Until March 31, service providers may grant additional logins to their current clients, provided that these clients promptly regularize their situation by obtaining a license from License2Publish or Copiepresse. As of April 1, a license agreement with a management organization must be signed before additional logins can be granted.
